Kiemas

Qué puedes y qué no puedes hacer

Si compras Pro, tu grupo no pasa a tener Pro.

No hace falta ninguna fórmula.

Terms of Use

By using Kiemas you accept these terms. They are written to be understood without being a lawyer.

What this service is

Kiemas is an app for saving places on a shared map and organising plans with a group. It is offered as is, with a free tier that is genuinely usable and a single paid upgrade, Kiemas Pro, which removes the limits.

It is available as a mobile app and also in the browser. The terms are the same for both.

Your account

You need an account to use it, and you must be at least 14 years old.

You are responsible for keeping your password safe and for what is done from your account for as long as access depends on you. Your session stays open on the device until you sign out, so on a shared device it is worth signing out.

That has a limit: if someone gets into your account through a security flaw in the app itself, or for any other reason not attributable to you, you are not the one answering for what is done from there. If you suspect it has happened, change your password and write to us: we look into it and, where appropriate, undo whatever was done.

One person, one account. Accounts may not be created by automated means, and you may not hand yours over to someone else.

You can close it whenever you like from Settings, without asking us and without giving a reason.

What you may and may not do

You can use the app for what it is meant for: saving places, organising plans and sharing them with whoever you decide.

You may not publish unlawful or offensive content, or content that infringes third-party rights; impersonate someone else; use the app to harass; or attempt to access spaces or data that are not yours.

You also may not extract content in bulk or by automated means, resell access, or use the app to build another service on top of it.

You can block other people and report content from within the app. Accounts that breach these terms may be suspended or closed, as set out below.

What you contribute

The content you upload remains yours. By contributing it to a space, you allow it to be shown to the people in that space, and if you publish a list, to anyone with the link or who finds it in Explore.

You are responsible for having the right to upload what you upload, in particular photographs, opinions and links.

A place can be copied to another of your groups. When you do that, the place details (name, address, category and little else) go to that other group and its members can see them. Notes, photos and ratings do not travel with the copy.

Kiemas ownership

Everything that makes up Kiemas (the app and web design, the source code, the structure, the logo, the trade name and the brand) belongs exclusively to its owner or is used under the corresponding licences.

We grant you a limited, personal permission to use the app under these terms, but that does not give you the right to copy, modify, distribute or resell it, nor to attempt to extract its source code.

That permission is not withdrawn on a whim. It can only be withdrawn, in whole or in part, if you breach these terms, if there is a security risk that justifies it, if a law or an authority requires it, or if the service stops being provided under the terms of the “If the service were discontinued” section. When it happens you are told why, and you can challenge it through the same route as any other moderation decision.

The free tier limits

The free tier allows up to 2 groups, 30 places and 3 plans at a time. The caps are per person and count across all your groups, not per group: a place you create counts towards yours, even though the whole group can see it.

Reaching a cap deletes nothing and removes you from nothing. You simply cannot create more until you delete something or move to Pro.

These numbers may change in the future, up or down, and you will be told inside the app. What will not change is what you already bought: that is the next section.

Kiemas Pro: a single payment

Kiemas Pro is bought once and that is it. It is not a subscription: it does not renew, you are not charged again, and there is nothing to cancel.

The price is set by the store for each country, taxes included. As of this document, it is €2.99 in Spain. The price that counts is always the one the store shows you before you confirm payment.

If the price goes up, the increase only affects new purchases. A completed purchase is never charged again, for any reason.

Pro is tied to your account and to the store account you paid with. It is not shared with your group, it is not enabled through Family Sharing, and it cannot be transferred, lent or resold. If you buy Pro, your group does not get Pro.

If you change phone or reinstall, sign in with the same Apple or Google account and tap “Restore purchases” in your profile. There is nothing to pay again.

What it unlocks: unlimited places, plans and groups. And a commitment we keep: if the free tier limits ever change, or the tiers are reorganised, your purchase will keep giving you at least what it unlocked on the day you made it. Nothing you already paid for will be moved behind a new payment.

You can also unlock a paid tier with a promotional code. A code is not a purchase: nothing is charged, it does not renew, and it expires on whatever date it carries.

Pro has no expiry date: it is a single payment, with no subscription and no renewals, and it lasts for as long as the service is provided. What happens if it stops being provided is set out below.

Who you buy from: the stores

The purchase is handled by the App Store or Google Play: the purchase contract is concluded with the store, which takes the payment, issues the receipt and handles refunds. We only receive notice that the purchase exists, in order to enable Pro for you.

That does not take us out of the relationship with you. Kiemas is the one providing the app and taking on the obligations regarding the service — that it works, that it conforms to what is promised, user support and everything these terms say. Payment going through the store does not change who you claim from about the service.

These terms are an agreement between you and the owner of the app. Apple is not a party to this agreement.

Apple has no obligation whatsoever to furnish any maintenance or support services for the app. If you need help, write to us.

If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price to you; beyond that refund, Apple has no other warranty obligation with respect to the app.

Any claim relating to the app — that it does not work, that it fails to comply with a legal requirement, that it infringes third-party rights, or product liability — is our responsibility and not Apple’s.

By using the app you represent that you are not located in a country subject to a US embargo and that you are not listed on any prohibited or restricted party list.

Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

In addition to these terms, you must comply with those of the store you downloaded the app from.

Right of withdrawal

If you are a consumer in the European Union, you have fourteen calendar days to withdraw from a distance purchase without giving a reason.

Because the purchase contract is concluded with the App Store or Google Play, that right is exercised with them and through their procedure, which you will find in the purchases section of your store account.

Kiemas Pro is not a file you download once and that is that: what you pay for is being able to go on using features of the app, in other words a digital service. So we do not tell you that you have lost your right of withdrawal merely because Pro activates at once: the immediate loss the law provides for digital content works differently for services, and you are not asked to give anything up here.

If you want to withdraw within those fourteen days, ask the store. Stores usually grant refunds even beyond what the law obliges them to; if they turn you down and you believe you were entitled, tell us and we look at it with you.

If you believe your consumer rights have not been respected, write to vazquezvalbuenaa@gmail.com before pursuing any other route: almost everything gets sorted there.

Other people’s content, reports and moderation

Kiemas hosts content uploaded by its users and does not review it before it is published. What someone writes or uploads is their responsibility.

If you see something that should not be there, tell us. Inside the app, on a person’s profile or on a place page, there is a report option: you pick a reason (spam, harassment, inappropriate content, false information or other) and can add an explanation. Writing to the contact address works too.

If what you saw is not just inappropriate but something you believe is illegal, that same screen has an “Illegal content” reason, which opens a different form. There you are asked to point to exactly which content you are reporting and where it is, to explain why you believe it is unlawful, to leave an email address so we can reply, and to confirm that what you say is accurate to the best of your knowledge. Those are the details Article 16 of Regulation (EU) 2022/2065 requires in order to treat the notice as a report of illegal content. Email works just as well, as long as it includes the same details.

A report of illegal content is acknowledged as soon as it arrives, examined without undue delay, and you are told the decision along with the ways you have to challenge it. If you leave an email address, the answer goes there.

What happens next: a person reads it. Nothing is removed by a program deciding on its own. If the content breaks the law or these terms, it is removed; if not, it stays. You are told what was decided and why, whether you are the person who reported it or the person who posted it.

When the decision affects you — something of yours is removed, its visibility restricted, your account suspended or closed — you get a statement of reasons that includes: what measure was taken and how far it goes; whether it affects only that content or your account too; the specific facts it is based on; whether it came from someone else’s report or from a check of our own; whether any automated tool was used to detect it; the exact legal provision or term considered breached, and why; and how you can challenge it. That is what Article 17 of the same Regulation requires.

If you disagree with the decision, reply to that same email explaining why; you have at least six months from when you were told. It is looked at again with whatever you add, a person reviews it, and you get another answer. No particular form is needed. Challenging it here takes no other route away from you: you can equally turn to an out-of-court dispute settlement body of the kind that Regulation provides for, or to the courts.

The possible measures, depending on severity and on whether it is repeated: a warning, removing the content, suspending the account or closing it. The least intrusive one that solves the problem is the one used.

It cuts both ways: anyone who repeatedly posts manifestly illegal content, or who repeatedly sends manifestly unfounded reports, may have their account suspended or their notices left unprocessed for a reasonable period. You are warned first.

You can block another person from their profile. From then on their content does not appear to you, nor yours to them. Blocking is your decision and it is private: the other person is not notified.

Closing an account for breaching these terms does not entitle you to a refund of Pro, unless the law requires it. Before it is closed you will be able to download your data.

Single point of contact for users and authorities, including as required by Regulation (EU) 2022/2065 on Digital Services: vazquezvalbuenaa@gmail.com. Attended in Spanish and English.

Availability and liability

The service is offered without any guarantee of uninterrupted availability. There may be technical outages, maintenance, or incidents caused by infrastructure providers (such as databases or hosting servers) outside our control.

The places on the map are put there by users and come from open map data. We do not guarantee that a place exists, that it is open, that the address is exact or that the price is still the one shown. Check before you go.

We are not liable for damage arising from misuse of the app, from accidental data loss due to external causes, or from what happens at the meet-ups you organise through it. None of this limits liability that the law does not allow to be excluded, and if you are a consumer your statutory rights are unaffected.

Download your data periodically from Settings if keeping it matters to you.

If the service were discontinued

The intention is to keep the service running. But a product can stop being provided, and saying so in advance is worth more than promising otherwise.

If it had to be shut down, you would be told inside the app and by email at least thirty days in advance. During that period you can download everything you have contributed from Settings.

The price paid for Kiemas Pro is claimed from the store where the purchase was made, which took the payment and handles refunds. Your consumer rights apply there as they do for any other digital purchase.

Put another way: Pro has no expiry date, but it cannot outlast the service itself. It is the other side of what the Pro section says.

Changes to these terms

These terms may change. Relevant changes will be announced inside the app before they take effect, with the date of the new version.

If you do not like a change, you can close your account. No change will take away what you already bought.

Small print worth stating

If Kiemas changed hands or were transferred to a company, these terms and your account would continue with whoever took over the service, on the same terms. You would be told inside the app before that happened.

We are not liable for failures caused by events outside our control and reasonably unavoidable: widespread internet outages, disasters, decisions by an authority, or an infrastructure provider shutting down.

If any part of these terms turns out to be void, the rest remains in force. The void part is replaced by whatever the law provides.

Not enforcing something at a given moment does not mean giving up the right to enforce it later.

These terms exist in Spanish and in English. If the two versions differ, the Spanish one prevails.

Governing law and complaints

Spanish law applies. For any dispute, if you are a consumer, you may bring proceedings before the courts of your place of residence.

Before that, write to vazquezvalbuenaa@gmail.com: you will get an answer.

As a consumer you can also turn to your local consumer information office (OMIC) or to the consumer body of your autonomous community. We are not signed up to any consumer arbitration scheme.

If your complaint is about personal data, the route is the Spanish Data Protection Agency (www.aepd.es).
